ORACIA (operated by E-VNTS Co., referred to as "ORACIA," "we," "us," or "our") is a software-as-a-service provider offering an AI-driven WhatsApp messaging solution for real estate professionals. Our platform enables real estate agents (our "Clients") to automate and enhance their WhatsApp conversations with their customers through an AI "autopilot" agent and smart reply suggestions.
This Privacy Policy explains how we collect, use, share, and protect personal data in the course of providing our services. It is designed to comply with WhatsApp's Business Terms and Policies, as well as applicable privacy laws in the regions we operate (including the United States of America and Brazil). We are committed to using WhatsApp Business data solely for the benefit of our Clients and in line with WhatsApp's requirements.
We process personal data on behalf of our Clients to provide the WhatsApp integration and AI services. The types of data and purposes are outlined below:
WhatsApp Message Data — message text content, media IDs, timestamps, and related metadata.
Client Account Data — business/agent name, WhatsApp Business Account ID (WABA ID), phone numbers, and configuration details.
Usage Metrics — interaction logs, feature usage data (e.g., messages sent, AI toggle events).
User Credentials — login information (email, auth ID).
Payment Data — subscription details, billing ID, transaction records.
Extended Storage of WhatsApp Message Data: ORACIA will retain message data for longer than 30 days only if (a) the Client has obtained explicit consent from the end-user to retain their conversation data for a longer period, or (b) retention is required due to a legal obligation. In such cases, we will abide by the scope and duration of the consent or legal requirement. If the Client does not have such consent or obligation, message contents older than 30 days are purged from our systems to respect user privacy and WhatsApp's data minimization expectations.
ORACIA processes personal data on the following legal bases (as applicable under relevant laws such as the LGPD in Brazil and applicable US regulations):
We are committed to data minimization, meaning we keep personal data only for as long as necessary to fulfill the purposes outlined above or as required by law.
Deletion Protocol: When data is deleted, we ensure it is removed from production databases and request deletion from any sub-processor holding it. Backups are configured to overwrite deleted data within a reasonable cycle (e.g., 30 days). If a Client leaves our service, we ensure their WhatsApp Business Account data is removed within 30 days of termination.

Because our services involve a chain of relationships (ORACIA as processor, the Real Estate Agent as controller, and the End-User as consumer), we facilitate rights as follows:
ORACIA is based in the United States, and our primary data hosting is in US data centers (AWS us-east-1 / us-west-2). If you access our service from outside the US (e.g., Brazil), your data will be transferred to the United States.
For Individuals in Brazil (LGPD Compliance):

Disclosure to End-Users: ORACIA acts as a service provider. We require our Clients to be transparent with their customers. Clients should inform end-users that a third party (ORACIA) processes their WhatsApp messages.
Compliance: Clients are contractually obligated to comply with WhatsApp's Business Messaging Policy and applicable privacy laws. Misuse of the platform (e.g., spam, harassment) will result in service suspension.
We may update this Privacy Policy to reflect changes in practices or legal requirements. Material changes will be notified to Clients via email or in-app alerts. The "Last Updated" date at the top indicates the latest revision.

By creating an account or using ORACIA, you agree to these Terms and to WhatsApp's Business Terms and Messaging Policy (incorporated by reference). The Service is for legitimate business use only. If you act for a business, you confirm authority to bind it.
ORACIA is for professional real estate businesses. End-users do not create accounts. You must provide real-estate credentials (CRECI in Brazil, NAR Member ID in the US, or equivalent), a valid WhatsApp Business number you control, and accurate business details. You are responsible for account security and all activity under your account. We may verify, refuse, or terminate accounts that fail eligibility or have prior policy violations.
ORACIA is a cloud platform integrating with the Meta WhatsApp Business Cloud API. Features include: Symbiotic Agent (Autopilot) for automated chats; AI-powered reply suggestions; contact and chat management; CRM sync. Not for emergencies — no access to 911/112. Service availability depends on third parties (Meta/WhatsApp, internet); we don't guarantee uninterrupted operation. AI features are tools; we don't guarantee outcomes.
Free trials may be offered at our discretion. Subscription fees are billed in advance, monthly or annually, in USD, plus applicable taxes. Plans auto-renew unless canceled before the period ends. Usage beyond plan limits may incur overage fees. Plan upgrades take effect immediately (pro-rated); downgrades at next cycle. Fees paid are non-refundable except where required by law. We may change pricing with advance notice; continued use after the change = acceptance.
You agree to comply with all applicable laws and WhatsApp policies. You are solely responsible for content you send. You will not:
We (and Meta/WhatsApp) may monitor usage for compliance. Violations may result in suspension or termination, with or without notice depending on severity.
You must maintain your own privacy policy disclosing your use of ORACIA and WhatsApp, and obtain all necessary consents from contacts. We act as a processor for end-user data, on your instructions. We do not sell personal data, do not data-mine your messages for profiling/advertising, and do not train generalized AI on your content. See the Privacy Policy for full detail.
ORACIA's software, brand, and platform are owned by E-VNTS Co. You receive a limited, revocable license for internal business use. You retain ownership of your content; you grant us a license to process it as needed to deliver the Service. You must not infringe third-party IP. Trademarks and feedback rules apply as detailed in §7.
The Service is provided "as is" and "as available." We disclaim warranties of merchantability, fitness, non-infringement, and accuracy to the fullest extent permitted by law. We do not guarantee deals, conversions, or third-party (Meta/WhatsApp) availability. Beta features are experimental.
You may cancel anytime; access continues to the end of the paid term. We may suspend/terminate for breach, security risk, or legal compliance — usually with notice and a chance to cure, but immediately for severe issues. We may also terminate for convenience with 30 days' notice and a refund of prepaid unused fees. Meta/WhatsApp can require immediate cutoffs we cannot override.
Neither party is liable for indirect/consequential damages. Our total liability is capped at fees paid in the 3 months prior to the event, or $100, whichever is greater. Meta/WhatsApp are released from liability and are third-party beneficiaries of these limitations.
You will indemnify ORACIA against claims arising from your misuse, legal violations, IP infringement, or interactions with your customers. We may control the defense at your expense. This obligation survives termination.
We may revise these Terms with reasonable notice for material changes. Continued use after the effective date = acceptance. Non-material updates may take effect on posting.
Governed by the laws of Delaware, USA. Disputes in DE state/federal courts. Independent contractors. Meta/WhatsApp are third-party beneficiaries where referenced. You may not assign without consent. Severability and no-waiver standard. These Terms (with the Privacy Policy and any Order Form) are the entire agreement.
